Lawyers for Kansas City’s Catholic bishop will argue in court this morning that a clergy sex abuse and cover up lawsuit should be tossed out because the alleged victim came forward too late.
The case, filed last September, is John Doe BP vs. Father Michael Tierney. The hearing will be at 10:30 in front of Judge Anne Mesle in the Jackson County courthouse.
Tierney was suspended from active ministry just last week by Bishop Robert Finn. He’s been named as an abuser in two civil suits.
“We abhor these hardball legal tactics,” said David Clohessy of St. Louis, Director of SNAP, the Survivors Network of those Abused by Priests (314 566 9790, SNAPclohessy@aol.com). “If Finn feels he and his staff did nothing wrong regarding Fr. Tierney, let them prove it in court.”

Finn’s lawyers claim the statute of limitations on any sexual misdeeds Tierney may have committed against Doe has expired.
“The statute is an archaic, predator-friendly law that Finn should not try to hide behind,” said Clohessy. “If Finn wants to fight this victim, the least he can do is fight on the merits, not on legal technicalities.”
